At Imaginaroo, our purpose is to foster learning, inspiration, and adventure through personalized media content. To personalize a book, we need some information about the person it's for (the "recipient"), including photos, and we know that is a lot of trust to ask for. This Privacy Policy explains what we collect, how we use it, who helps us, how long we keep it, and the choices you have. We say "book" throughout, but this policy covers all of our personalized products.

This policy applies to imaginaroo.com and to the previews, proofs, emails and other services that link to it (together, our "Services"). "Imaginaroo," "we," "our," and "us" mean Imaginaroo Inc. Your use of our Services is also subject to our Terms of Service.

The short version

• We use your photos only to make your preview and book, support your order, and for safety and legal reasons.
• Personalized illustrations are created with the help of artificial intelligence (AI). Photos you upload are not used to train AI models.
• We don't sell your personal information for money, and you can opt out of targeted advertising at any time. We never use your photos, a recipient's name or likeness, or your book in our advertising without your separate permission.
• We don't keep photos longer than we need them.
• You can ask us to access or delete your information at any time by emailing support@imaginaroo.com.

Information we collect

Information you give us

Contact and order details: your name, email address, phone number (if you provide one), billing and shipping addresses, and what you ordered.

Personalization details: the details you choose for the book, such as the recipient's first name, age, gender, favorite team or place, and your dedication message.

Photos: the photos you upload of the recipient who will appear in the book.

Your messages: feedback on a preview or proof, requests for changes, and anything else you send us.

Payment information: card payments are handled by our payment processor. We don't see or store your full card number.

Information collected automatically

When you visit our website, we, our e-commerce platform (Shopify) and our analytics and advertising partners automatically collect some information using cookies and similar technologies. This includes your IP address, browser and device type, pages viewed, the site that referred you, and your approximate location based on your IP address. See "Cookies, analytics and advertising" below.

Information from others

If someone orders a book for you or your child, we receive the information they provide. If you order through a school or organization fundraiser, we may receive information from that organization, such as which fundraiser your order supports.

How we use information

• To create your preview and your book: we use photos and personalization details to generate the illustrations, assemble your proof, and print and ship your book.
• To communicate with you about your preview, proof, order, shipping and any questions you have.
• To handle feedback, revisions, replacements and refunds.
• To send marketing emails if you have signed up for them. You can unsubscribe at any time.
• To run and improve our Services, for example to fix problems, understand how our website is used, and check the quality of our books. Our team may review previews and proofs for quality. We do not use your photos to train AI models.
• To detect and prevent fraud and abuse, to comply with the law, and to enforce our Terms of Service.

Photos and AI Illustrations

Here is what happens to the photos you upload:

• Creating illustrations. We send your photos, together with instructions for each scene, to a third-party AI service that generates the illustrations for your book. That service processes the photos on our behalf under its business terms. It does not use them to train its models, and it may keep them for a limited period for safety and abuse monitoring before deleting them.
• No facial recognition. We don't use facial recognition technology, and we don't create face templates or other biometric identifiers from your photos. Photos are used only to create your illustrations.
• Making your book. People on our team and our printing partner may see your photos and illustrations while making your book.
• Private links. Your preview and proof are shared with you through private links. Anyone who has the link can view it, so please only forward it to people you'd like to see the book.
• No advertising. We don't use your photos, a recipient's name or likeness, or your book in advertising, on social media or as examples without your separate, express permission.
• Photo details. Photos can contain hidden details from your camera, such as when a photo was taken. We don't use those details.

Information about recipients, including children

Many of our books are about someone other than the person ordering, such as a child, a parent or a partner. By uploading a photo, you confirm that you have permission to use it: if the person pictured is an adult, their permission; if a child, you are the child's parent or legal guardian or have their permission. We use a recipient's information only to make the book, support the order, and meet our legal obligations.

Anyone who appears in a book, or the parent or guardian of a child who does, can ask us to delete that information at any time, even if someone else placed the order. Email support@imaginaroo.com with the order number or the email address used to order if you have them. If you don't, tell us the recipient's first name and the name of the person who ordered, and we'll confirm with them before acting.

Children

Our Services are for adults. They are designed for people buying books, including books for children, and are not directed to children. We don't knowingly collect personal information directly from children under 13, and children should not use our website or contact us themselves. Information we have about a child comes from an adult. If we learn that we have collected personal information directly from a child under 13 without a parent's consent, we will delete it.

How we share information

We don't sell your personal information for money. We share it only in the following situations.

Service providers

We use trusted service providers to run our business. They include our e-commerce and payment platform, our photo upload tool, our AI illustration service, our cloud storage and productivity tools, our email and messaging tools, our printing and fulfillment partner, and shipping carriers. We give our service providers only the information they need, and we don't allow them to use photos or a recipient's information for their own purposes. Some large platforms we rely on, such as our e-commerce platform and shipping carriers, also handle information under their own privacy policies.

Analytics and advertising partners

Our website analytics and advertising partners collect information about how visitors use our website, as described in "Cookies, analytics and advertising" below. They use it under their own privacy policies. We never share photos or a recipient's personal details with them.

Fundraising partners

If you order through a school or organization fundraiser, we may share limited information with that organization, such as your name and the amount of your purchase credited to it. We don't share photos or a recipient's personal details with fundraising partners.

Law enforcement, mergers, and other situations

We may be required to share your personal information in other, limited circumstances. For example, we may be required to share certain information to respond to a subpoena or similar judicial process, to comply with state, federal or local laws, to protect the security or integrity of our databases or website, to take precautions against liability, in the event of a corporate reorganization or, to the extent required by law, to provide information to law enforcement agencies. If necessary, we may also share information with law enforcement without a subpoena or similar judicial process if doing so may help protect the personal safety of a customer, a photo subject, or members of the public.

Additionally, your information may be transferred to another organization if, for example, we transfer the ownership or operation of our Services because we have merged with or have been acquired by another organization, or if we liquidate our assets. In those cases, the new company's use of your information will still be subject to this Privacy Policy and the privacy preferences you have expressed to us.

With your permission

We may share information in other ways if you ask us to or give us permission.

Cookies, analytics and advertising

We and our partners use cookies, pixels and similar technologies to keep items in your cart, remember your preferences, understand how our website is used, and measure and improve our advertising. Some advertising partners may use information collected on our website to show you Imaginaroo ads on other websites and apps. Under some state laws, this is considered "sharing" or "selling" personal information for targeted advertising.

You can opt out of this at any time:

• Use the "Your privacy choices" link at the bottom of our website.
• Turn on Global Privacy Control (GPC) in your browser. We treat a GPC signal as a request to opt out of targeted advertising for that browser.
• Change your browser settings to block or delete cookies. Some parts of our website, such as the cart, may not work without them.
• Use industry opt-out tools such as those offered by the Network Advertising Initiative (optout.networkadvertising.org) and the Digital Advertising Alliance (optout.aboutads.info).

Browsers also offer a "Do Not Track" setting. Because there is no common standard for it, we respond to Global Privacy Control as described above rather than to Do Not Track signals.

How long we keep information

We keep personal information only as long as we need it for the purposes described in this policy.

• Photos you upload are kept only as long as we need them to create your preview or book, make revisions, and resolve any issues with your order. Photos and illustrations from previews that don't become orders are deleted periodically after the preview expires.
• Illustrations and book files may be kept for longer so that we can reprint or replace your book if needed. We delete them periodically.
• Order records are kept as long as needed for accounting, tax and legal purposes.
• Marketing preferences are kept until you unsubscribe, and afterward so that we can respect your choice.

If you'd like us to delete something sooner, just ask.

Your choices and rights

Wherever you live, you can ask us to:

• tell you what personal information we have about you and give you a copy;
• correct information that is wrong;
• delete your information, including photos and a recipient's information;
• stop sending you marketing emails; and
• stop using your information for targeted advertising.

To make a request, email support@imaginaroo.com with "Privacy request" in the subject line. To protect you, we'll confirm your request using the email address you gave us (for example, the one on your order or preview) before acting on it. You can also have an authorized agent make a request for you; we may ask for proof of their authority. We will respond within the time required by applicable law.

We may keep some information when we're required or permitted to by law, for example order records needed for tax purposes. If we can't fulfill a request, we'll explain why. If you disagree with our decision, reply with "Appeal" in the subject line and we'll review it again. If you're still not satisfied, you can contact your state attorney general.

We will not treat you differently or charge you a different price for exercising your privacy rights.

Residents of California, Colorado, Connecticut, Virginia, Texas, Oregon and a growing number of other states have specific rights under state privacy laws. The rights above are how we honor them, and we extend them to all of our customers. California residents may also request information about disclosure of personal information to third parties for their own direct marketing; we don't make those disclosures.

How we keep your information secure

Although no website, application, database or system is completely secure or "hacker proof," we have safeguards in place to protect against unauthorized access and disclosures of the personal information we control, including technical, physical and administrative safeguards and security measures. Despite these measures, however, we cannot guarantee that our information security safeguards will never be compromised.

Visitors from outside the United States

Our Services are operated from the United States and we currently ship only within the United States. By using our Services, you acknowledge that your information may be transferred to, stored or processed in the United States in accordance with this Privacy Policy and applicable United States laws. Please be aware that U.S. privacy laws may differ from those that apply in the country in which you reside.

Changes to this policy

As we introduce new services or otherwise change our privacy practices, or in response to changes in applicable laws or regulations, we may update this Privacy Policy by posting the new version on this page and changing the "Last updated" date. If we make a material change, we will notify you by email or with a notice on our website before it takes effect.
